3.3 2026 Summer Intergovernmental Relations Report. (a) Accept the 2026 Summer Intergovernmental Relations Report. (b) Reaffirm all City positions summarized in the 2025-2026 Intergovernmental Relations Priority Federal Legislation Log. (c) Reaffirm all City positions summarized in the 2025-2026 Intergovernmental Relations Priority State Legislation Log. CEQA: Not a Project, File No. PP17-010, City Organizational and Administrative Activities resulting in no changes to the physical environment. (City Manager) Public Comment: None provided. Emily Lam, Director, City Manager’s Office - Office of Administration, Policy, and Intergovernmental Relations (IGR); Han Kang, Chief IGR Officer, City Manager’s Office - IGR; Steve Stamos, Senior Executive Analyst, City Manager’s Office - IGR; and Nicholas Ochoa, Senior Executive Analyst, City Manager’s Office - IGR, offered the presentation and responded to questions from the Council. Motion: Councilmember Domingo Candelas made a motion to accept the joint memorandum, dated September 18, 2026, co-authored by Councilmember George Casey and Councilmember Domingo Candelas. The motion was seconded by Councilmember George Casey. Substitute Motion: Councilmember Anthony Tordillos made a substitute motion to accept the staff recommendation and direct the City Manager’s Office to return to Council through the January 2027 Legislative Program Update with recommendations for how the City can advocate for legislation to provide additional flexibility, discretion, and local control for pro-housing cities pursuing their housing goals in good faith while retaining tools to hold cities acting in bad faith accountable and enforcing minimum statewide standards for such cities. The substitute motion was seconded by Councilmember Rosemary Kamei. Friendly Amendment: Councilmember Rosemary Kamei requested a friendly amendment to the motion made by Councilmember Domingo Candelas and seconded by Councilmember George Casey to replace Item 2 in the September 18, 2026 joint memorandum authored by Councilmember George Casey and Councilmember Domingo Candelas with the language “Write a letter of concurrence on local control.” The maker of the motion denied the friendly amendment. San José City Council September 22, 2026 Action: On a call to question, the substitute motion, made my Councilmember Anthony Tordillos and seconded by Councilmember Rosemary Kamei, to accept the staff recommendation and direct the City Manager’s Office to return to Council through the January 2027 Legislative Program Update with recommendations for how the City can advocate for legislation to provide additional flexibility, discretion, and local control for pro-housing cities pursuing their housing goals in good faith while retaining tools to hold cities acting in bad faith accountable and enforcing minimum statewide standards for such cities, did not pass due to a lack of yes votes. (4-7-0; Noes: Ortiz, Mulcahy, Doan, Candelas, Casey, Foley, Mahan) Action: On a call to question, the Council approved the motion made by Councilmember Domingo Candelas and seconded by Councilmember George Casey, including the following actions: (a) The 2026 Summer Intergovernmental Relations Report was accepted; (b) All City positions summarized in the 2025-2026 Intergovernmental Relations Priority Federal Legislation Log were reaffirmed; and (c) All City positions summarized in the 2025-2026 Intergovernmental Relations Priority State Legislation Log were reaffirmed. AND Including approval of the September 18, 2026 memorandum, authored by Councilmember George Casey and Councilmember Domingo Candelas, recommending the following: Accept the staff recommendation and direct the City Manager to: 1. Add a policy position to the 2027 Legislative Program supporting legislation that restores and strengthens local control over housing and land use matters such as those identified in the League of C
